Even though it have a patient's information on them, medical records are property of the healthcare provider.
But cannot be released short the patient's written consent.

No, they do not belong to the patient. Medical paperwork are the property of the medical provider (or facility) that prepares them. This includes films and tracings from diagnostic imaging procedures such as x-ray, CT, PET, MRI, ultrasound, etc. The patient have a right to view the original, and to obtain copies lower than Health and Safety Code sections 123100 - 123149.5.
There is no broad law requiring a physician to declare medical records for a specific interval of time. However, there are situations or establishment health plans that require a provider/physician to continue their records for a persuaded period of time. Several law specify a three-year retention period: Welfare and Institutions Code wedge 14124.1 (which relates to Medi-Cal patients), Health and Safety Code section 1797.98(e) (for services reimbursed by Emergency Medical Services Fund), and Health and Safety Code article 11191 (when a physician prescribes, dispenses or administers a Schedule II controlled substance). The Knox-Keene Act requires that HMO medical accounts be maintained a minimum of two years to ensure that compliance near the act can be validate by the Department of Corporations. In Workers' Compensation Cases, qualified medical evaluators must maintain medical-legal reports for five years. Health and Safety Code clause 123145 indicates that providers who are licensed under passage 1205 as a medical clinic shall preserve the records for seven years. However, at hand is no general statute which relates to adjectives other types of medical records.

You both own them which is why you can obtain a copy for your self. If you move other get a copy of your med. directory, for the new Dr. that route you won't be misdiagnosed or have to repay for tests that you already salaried for, that's a waste of your time and firm earned money.
It doesn't situation what country you go to or live contained by the med. records are both yours and the strength care providers The judgment they keep a copy even if you are disappearing are legal reason and that's good surrounded by case you lose your copy contained by a fire or something you can get another copy of your store.
Scientif... I have every x-ray and MRI and cat scan that I own ever had taken, on my shelf contained by my closet. They are mine. I did not pay any extra for them since I salaried to have them taken and rightfully they belong to me. I also have my med. annals from when I was a child and I am 46 and own all my files for my lifetime.
technically your records cannot be released in need your consent however, certain management agencies may supeona your records for diverse reasons. try visit the website for aclu- you should be able to find info on this subject, lately the government get hold of womens records about late possession abortions to prosecute them, I forget which state.
some people run to the hospital as Jane or John Doe to truly protect their privacy, even doctors will not allow doctors to put the diagnosis of hiv+ on their personal charts- these doctors die of pneumonia
We own our own medical records! IF we ever want our chronicles or a copy of them, they are to be given to us! We can give authorization to have "our" information given to a specified Dr. or facility, but they are ours. This is OUR personal information. My daughter have been an RN for 20+ yrs. & have often stated that individuals are unaware of their rights when it comes to our bodies, WE own the say of what we want or do not want done to them.
